Regulations of the Love Montessori Online Store

Definitions

Price – The gross amount of remuneration specified in Euro (including applicable taxes) due to the Seller for the transfer of ownership of the goods to the Customer in accordance with the Sales Agreement.

Regitrationn form – A form available in the Store that allows for the creation of an Account.

Statement order form – An interactive form available in the Store that allows for placing an Order, particularly by adding Products to the Cart and specifying the conditions of the Sales Agreement, including the method of delivery and payment.

Customer – Any entity making purchases through the Store, after accepting the Terms and Conditions.

Consumer – An individual who performs a legal action with the Seller that is not directly related to their business or professional activity, particularly entering into a sales agreement via the Store.

Customer account/Account – A space provided to the Customer within the Store, activated on their behalf by the Seller (after the Customer registers and thus enters into a service agreement for maintaining a Customer Account), where data provided by the Customer during the registration of the Customer Account is stored. Account creation is not required for the use of the Store, including browsing the Store’s Products and placing orders.

Civil Code – The Act of April 23, 1964, of Poland (Journal of Laws 1964 No. 16, item 93, as amended).

Cart – A service provided to every Customer and user of the Store, enabling them to easily purchase one or more Products in the form of a PDF file, display a summary of the purchase Price of individual Products and all Products collectively, and for logged-in users, remember Products added to the Cart even after the browser session ends.

Entrepreneur with Consumer Rights – An individual who enters into a Sales Agreement with the Seller directly related to their business activity, but not of a professional nature, which particularly arises from the nature of their business activity available in the Central Registration and Information on Economic Activity.

Terms and Conditions - The present Terms and Conditions for the provision of electronic services within the online store www.lovemontessori.pl/en/;

Store - The Love Montessori online store available at http://lovemontessori.pl/en/ operated by the Seller, serving as a sales platform through which the Customer can place Orders;

Seller - An individual conducting business under the name Anna Kukiz – Szczałuba, St Afrykańska 7/91, 03-966 Warsaw, registered in the Central Registration and Information on Economic Activity (CEIDG) maintained by the Polish Minister of Economy, NIP 792 154 02 49, REGON 146567624.

Digital Content - Content created and delivered in the form of a PDF file not saved on a tangible medium, provided by the Seller via email through the Store to the Customer, after the payment of the Price. Whenever the Terms and Conditions refer to Products or Files, it also includes Digital Content unless otherwise stated in the provision.

Agreement for the Supply of Digital Content - An agreement concluded using remote communication means concerning the supply of Digital Content by the Seller to the Customer for a Price. Whenever the Terms and Conditions refer to the Sales Agreement, it also includes the Agreement for the Supply of Digital Content unless otherwise stated in the provision.

Sales Agreement - A sales agreement as defined by the Civil Code of Poland, concluded using remote communication means and concerning the sale of Products by the Seller to the Customer for a Price with the addition of any shipping costs.

Service Agreement - The present document specifying the rules for entering into Sales Agreements and the rules for providing and using services offered by the Seller via the Store to Customers. The Terms and Conditions define the rights and obligations of the Customer and the Seller. Regarding electronic services, the present Terms and Conditions are the regulations referred to in Article 8 of the Act of July 18, 2002, of Poland, on the provision of electronic services (Journal of Laws 2002 No. 144, item 1204, as amended);

Contract Concluded at a Distance - A contract concluded with a Customer as part of an organised system for concluding distance contracts (within the Store), without the simultaneous physical presence of the parties, using exclusively one or more means of remote communication up to the moment the contract is concluded.

Consumer Rights Act - The Act of May 30, 2014, of Poland, on consumer rights (Journal of Laws 2014, item 827, as amended).

Technical Requirements - The minimum technical requirements necessary to use the Store, enter into an Agreement for the Supply of Digital Content, or enter into a Sales Agreement.

Order - A declaration of will by the Buyer made through the Store, specifying the Products the Customer intends to buy and the Customer’s data necessary to conclude and execute the Sales Agreement or the Agreement for the Supply of Digital Content.

General Provisions

1. The Love Montessori online store, operating at the web address https://lovemontessori.pl/en/, is operated by Anna Kukiz-Szczałuba, St Afrykańska 7/91, 03-966 Warsaw, Tax Identification Number (TIP): PL792 154 02 49, National Business Registry Number (REGON): 146567624..

2. The present Terms and Conditions apply to both Consumers and Entrepreneurs with Consumer Rights using the Love Montessori Store and specify the rules for using the online store, as well as the rules and procedures for concluding Sales Agreements with Customers and Entrepreneurs with Consumer Rights at a distance through the Love Montessori Store.

3. Through the Store, the Seller provides a service by electronic means to the Consumer and Entrepreneur with Consumer Rights, consisting of enabling the Consumer and Entrepreneur with Consumer Rights to conclude with the Seller an agreement for the supply of Digital Content in the form of PDF files available in the Store.

4. The Terms and Conditions specify the rules and conditions for using the Store, as well as the rights and obligations of the Seller and the Customer.

Rules for Using the Online Store

1. Information provided on the Store's website, including information about presented products, especially their descriptions, technical and functional parameters, and Prices, constitutes an invitation to enter into an agreement within the meaning of Article 71 of the Civil Code of Poland.

2. To make a purchase through the Store, it is necessary for the Customer's computer or other device to meet the following technical requirements: a. a computer or mobile device with internet access and software allowing browsing of websites, b. a standard operating system, c. having an active email address, d. enabling the ability to save cookies files in the internet browser.

3. To use PDF files, the following technical requirements must be met by the Customer's computer or other device: a. a dedicated Adobe Acrobat Reader software released no earlier than 2020, for opening and printing downloaded Products in PDF formats, or other software capable of handling PDF files.

4. Placing an Order is done using the Order Form available on the Store's website.

5. Each Consumer registering and/or placing an Order agrees to receive information related to the transaction progress, notifications of changes in the present Terms and Conditions to the email address provided by them.

6. To ensure the security of communication and data transmission related to services provided within the Store, the Store implements technical and organisational measures appropriate to the degree of security threat of the services provided, in particular measures to prevent unauthorised access to personal data transmitted over the internet. The Customer should inform the Seller of any irregularities or interruptions in the functioning of the Store.

7. The Seller shall not be liable to the widest extent permitted by law for disruptions, including interruptions in the functioning of the Store caused by force majeure, unauthorised actions of third parties, or incompatibility of the online Store with the Customer's technical infrastructure.

8. The Sales Agreement is concluded in English.

Account Creation in the Store

1. The Seller provides the Customer with the possibility to create an Account in the Store. Account creation is possible via the Registration Form or when placing an Order.

2. Registration of a Customer Account is voluntary, in particular in the sense that the Customer may browse the Store's assortment and place Orders without registering a Customer Account.

3. If the Customer decides to create an Account in the Store, the Seller also provides an electronic service free of charge to the Consumer and Entrepreneur with Consumer Rights, consisting of maintaining the Account in the Store. The Account stores the Customer's data and the history of Orders placed by them in the Store. The Customer logs into the Account using their email address and a password defined by them.

4. The Consumer and Entrepreneur with Consumer Rights are entitled to terminate the agreement for the provision of the Customer Account service at any time, without notice, without giving a reason, and without incurring any costs, in particular by sending a request for deletion of the Account to the Seller via email to: sklep@lovemontessori.pl, specifying the email address registered in the Store.

Rules for Selling Digital Content

1. A Consumer and an Entrepreneur with Consumer Rights may order only one copy of a given digital product.

2. To purchase Digital Content, the Customer must take the following steps: a. add the Product or Products to the Cart by clicking the 'Add to Cart' button, b. from the Cart view, click the 'Proceed to checkout' button, c. fill out the Order Form, providing the necessary data for Order fulfilment and selecting the payment method, d. verify the correctness of the provided data, e. accept the Terms and Conditions - acceptance of the Terms and Conditions is voluntary but necessary to complete the purchase, f. accept the consent to the delivery of Digital Content before the expiration of the withdrawal period from the contract - acceptance is voluntary but necessary to complete the purchase, g. choose the payment method, h. click the 'Buy and pay' button.

3. After successful payment, the Customer will be redirected to a purchase confirmation page. At this point, the Agreement for the supply of Digital Content in the form of the selected Products is deemed concluded between the Consumer or Entrepreneur with Consumer Rights and the Seller. The purchase confirmation will also be sent to the Customer's email address provided in the Order form.

4. Deliveries are made via email, so the Products do not have physical packaging. Expressing the desire for electronic delivery also confirms acknowledgment that the mere fact of delivering the email package is equivalent to 'unpacking'/installing the Digital Content.

Order Delivery

1. Purchased products will be delivered as follows: a. the purchased Digital Content in the form of a PDF file will be made available immediately after the payment is credited to the Seller's account, b. the file will be provided by sending a link to the digital file to the email address provided in the order, c. the link will be active for two weeks from the moment it is sent to the Customer's email address. During this time, the Customer has the opportunity to download the digital file and save it on their device, d. when choosing the traditional bank transfer payment option, the delivery time should include the time required for the funds to be credited to the Store's bank account.

2. If fulfilling the Order is not possible, the Store will inform the Customer about the situation by sending a message to the email address provided by the Customer. In the event that the Customer has made a prior payment for such an Order, the Store will refund the paid amount.

Withdrawal from Agreement and Complaints

1. The right to withdraw from the agreement does not apply to the Consumer and the Entrepreneur with Consumer Rights with regard to the Agreement for the Delivery of Digital Content that is not stored on a tangible medium if the performance has commenced with the Consumer's explicit consent before the expiration of the withdrawal period from the contract and after the Store has informed the Customer of the loss of the right to withdraw from the agreement (in accordance with Article 38 of the Act of May 30, 2014, of Poland, on Consumer Rights - consolidated text of June 24, 2014, Journal of Laws of 2014, item 827).

2. All complaints related to the functioning of the Store can be reported by the Consumer and the Entrepreneur with Consumer Rights via email at sklep@lovemontessori.pl. In the complaint, the Customer should provide their full name, mailing address, as well as the type and date of occurrence of the irregularity related to the functioning of the Store.

3. The Seller will consider all complaints within 14 calendar days of receiving the complaint and will inform the Customer of its resolution via email to the address provided in the complaint.

Prices and Payment Methods

1. Product prices are provided in Euros and include all components, including VAT.

2. The Seller reserves the right to update the prices of Products displayed on the Store's website. Prices in Orders placed by the Consumer or the Entrepreneur with Consumer Rights before the changes are made remain binding for the Customer.

3. The only available payment option in the Store is electronic payment.

5. Card payments are processed through the Przelewy24 payment system. The operator of payment cards is: PayPro SA, Payment Agent, St Pastelowa 8, 60-198 Poznań, entered into the Entrepreneurs Register of the National Court Register kept by the District Court Poznań Nowe Miasto i Wilda in Poznań, VIII Economic Department of the National Court Register under the KRS number 0000347935, Tax Identification Number: 7792369887, National Business Registry Number: 301345068.

6. If the Consumer or the Entrepreneur with Consumer Rights has requested an invoice, it will be delivered electronically to the email address provided during Order fulfilment.

Intellectual Property Rights

1. The sale of Digital Content allows the Customer to use the PDF file solely for their own use. The Seller hereby informs the Customer that the Digital Products available in the Store are works within the meaning of the Act of February 4, 1994, of Poland, on Copyright and Related Rights, for which the copyright belongs to the Seller. The sale of a File containing Digital Content does not mean the transfer of copyright or the granting of a license to works, artistic performances, or other intellectual property rights contained in the File.

2. The Seller informs the Customer that further distribution of Digital Products by the Customer without the Seller's consent constitutes a violation of the Seller's copyright and may result in civil or criminal liability.

3. Any reproduction, duplication, distribution, or dissemination of the File other than specified in the present Terms and Conditions requires the consent of the rights owner, except where expressly permitted by law.

Final Provisions

1. Matters not regulated in these Terms and Conditions are subject to Polish law, in particular the Civil Code and the provisions of the Act on Special Conditions of Consumer Sales and Amendments to the Civil Code of July 18, 2002 (Journal of Laws of 2001 No. 144 item 1204), the Act on Consumer Rights of May 30, 2014 (Journal of Laws of 2014, item 827, as amended), and other relevant provisions of generally applicable law.

2. The current version of the Terms and Conditions is available at https://lovemontessori.pl/en/.

3. The Seller reserves the right to make changes to the Terms and Conditions for valid reasons, including: a. changes in the law; b. organisational reasons, in particular: changes in the scope of the Seller's business, such as changes in its profile, changes in the range of Products, introduction of new services or facilities (including those related to the conclusion and termination of contracts), changes in the scope of: address details, name or legal form of the Seller, changes in payment methods, changes in methods of Goods delivery, other technical changes related to the operation of the Store.

The European Commission provides a platform for online dispute resolution. This allows consumers to resolve disputes related to online orders without involving a court.
